Update: FTC Upholds Administrative Law Judge Decision Regarding POM (no evidence of) Wonderful

On January 10th, the Federal Trade Commission (the “FTC”, the US agency responsible for protecting consumers from fraud and deception) upheld an Administrative Law Judge’s decision that unsupported claims were made about POM products in advertisements.

As I reported here, in May 2012, FTC Administrative Law Judge upheld a FTC complaint against the makers of POM Wonderful 100% Pomegranate Juice and POMx supplements.  The FTC alleged that the advertising of the POM products made false and unsubstantiated claims relating to the prevention or treatment of heart disease, prostate cancer and erectile dysfunction.  Continue reading

Branding Foods and Beverages in Canada

Hello all!

I just had an article publish in Lawyer’s Weekly Magazine and thought some of you might be interested in reading it.

The article is about using intellectual property (IP) and regulatory laws to brand foods and beverages.  IP and regulatory laws are really the heart of my practice (in the food space and otherwise) and I like to say they go together as well as wine and cheese, or popcorn and chocolate (don’t dis it until you’ve tried it!).  I hope you enjoy the article (and learn something about what I do as a regulatory and branding lawyer)! The US Food Safety Modernization Act – Progress!

Happy New Year readers!  I hope you all had a fantastic holiday and that you are well-rested and ready to tackle 2013 (bring it!).

For my first posting of the New Year, physician I’m delighted to report on progress in the wide world of food safety.

As many of you know, I have been closely following the FDA’s progress in implementing the Food Safety Modernization Act (FSMA) – it’s been slow and many of the deadlines provided for in the Act have come and gone. Continue reading
